DIGITEL PRO TERMS AND CONDITIONS OF SALE AND USE

1. ACCEPTANCE OF TERMS

1.1. Introduction Welcome to Digitel Pro. These Terms and Conditions, together with our Privacy Policy and Returns Policy, govern your use of the website digitelpro.co.za (the “Website”) and the purchase of any goods from Digitel Pro (Pty) Ltd, a South African business. 1.2. Agreement By accessing, browsing, or using the Website, registering an account, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website. 1.3. Legal Capacity You warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under 18, you may only use the Website with the supervision and assistance of a parent or legal guardian.

2.2. Protection of Personal Information (POPIA) We are committed to protecting your privacy. Our collection, use, and storage of your personal information are governed by our separate Privacy Policy, which is compliant with the Protection of Personal Information Act (POPIA). By agreeing to these T&Cs, you consent to the processing of your personal information as set out in our Privacy Policy.  

3. PRODUCTS, STOCK & GRADING

3.1. Products Sold Digitel Pro sells both Brand New Sealed Devices and Pre-Owned Devices, primarily Apple products (iPhones, Macs, iPads, etc.) and other consumer electronics. 3.2. Pre-Owned Device Grading All Pre-Owned Devices undergo a rigorous 30-point check system. Products are graded to manage customer expectations. The grades are generally defined as:

  • A-Grade: Near-mint condition. Screen and housing show minimal to no signs of wear, visible only upon very close inspection. Battery health is typically above 90% (or as specified).
  • B-Grade: Excellent condition. Screen may have a few faint, small scratches not noticeable during use. Housing may have minor blemishes. Battery health typically above 80% (or as specified).
  • C-Grade: Good/Used condition. Screen may have visible scratches. Housing may show clear signs of use, such as minor dents or scuffs. Fully functional. Battery health typically above 80% (or as specified).

Note: Specific details (e.g., exact battery health %) will be noted on the product listing. 3.3. Availability and Errors We take all reasonable efforts to ensure accurate information, including the availability and price of goods.

  • If, after you have placed an order and made payment, the goods are found to be unavailable, we will notify you and issue a full refund or offer an alternative product of similar value.
  • We reserve the right to correct any errors in product descriptions, pricing, or stock availability.

 

4. PRICING AND PAYMENT

4.1. Pricing The price of each product is displayed on the Website. All prices are in South African Rand (ZAR) and include VAT (if applicable). 4.2. Payment Methods We accept various payment methods, including but not limited to:

  • Credit and Debit Card payments
  • Electronic Funds Transfer (EFT)
  • Flexible payment options: PayFlex, Fevertree, Float. (Use of these third-party services is subject to their own terms and conditions.)
  • Cash on Delivery (COD) in designated Durban areas, by appointment only.

4.3. Lay-Buy Policy We offer Lay-By agreements over a period of 3 to 6 months.

  • A minimum deposit of 40% is required to secure the item.
  • The Lay-By contract is governed by the CPA. Should you cancel the Lay-By, we reserve the right to charge a reasonable cancellation penalty as permitted by law, generally 30%.

 

5. WARRANTIES AND DEFECTS

5.1. Standard Warranties The following hardware warranties apply from the date of purchase:

  • Brand New Sealed Devices: A standard 12-Month warranty against manufacturing defects, facilitated through Digitel Pro or the authorized manufacturer channel.
  • Pre-Owned Devices (iPhones): A standard 3-Month hardware warranty.
  • Other Pre-Owned Devices (Macs, iPads, etc.): Warranty periods will be specified on the product page (e.g., 6 months, 12 months).

5.2. Warranty Conditions and Exclusions Warranties cover hardware faults only. Warranties are immediately voided if:

  • Damage is caused by drops, liquid spills, neglect, or physical abuse.
  • The product is subjected to electrical surges, improper installation, or use contrary to the manufacturer’s or Digitel Pro’s instructions.
  • Any evidence of moisture, rooting, jailbreaking, or software tampering is present.
  • Repairs or disassembly are attempted by the user or any third party not explicitly authorized by Digitel Pro.
  • Consumables such as batteries, cables, or accessories are excluded from the main device warranty unless explicitly stated.

5.3. Assessment Fee If a returned device is found to have no fault, or if the fault is deemed to be a result of physical or liquid damage that voids the warranty, Digitel Pro reserves the right to charge a fee of R299 for assessment and handling.  

6. RETURNS AND REFUNDS

6.1. 7-Day Cooling-Off Period (CPA Compliant) In terms of the Consumer Protection Act (CPA), you are entitled to cancel a transaction within 7 calendar days of receipt of the goods for non-defective reasons.

  • To qualify for a return, the goods must be unused, in their original condition, and returned with all original packaging, manuals, and accessories.
  • Restocking Fee: We reserve the right to charge a reasonable handling/restocking fee if the goods or packaging are not returned in their original purchase condition.
    • For Pre-Owned Devices: A restocking fee of up to 15% of the product value may apply.
    • For New/Sealed Devices: A restocking fee of up to 30% of the product value may apply if the original seal has been broken or the box is damaged.

6.2. Return Procedure

  • All returns must be formally requested via email within the applicable period.
  • Customer Data Responsibility: For all returned electronic devices (laptops, phones, tablets), you are responsible for:
    • Backing up any personal data.
    • Deleting all personal data.
    • Factory resetting the device before returning it. Digitel Pro is not liable for any data left on returned devices.

6.3. Refunds Approved refunds will be processed via EFT to a nominated South African bank account or a credit card reversal. Refunds may take 10-14 working days to reflect, depending on your bank.  

7. SHIPPING AND DELIVERY

7.1. Nationwide Delivery We ship nationwide across South Africa using reputable courier services (e.g., The Courier Guy). A tracking number will be provided once your order is dispatched. 7.2. Delivery Risk Transfer The risk of loss or damage to the goods transfers to the customer upon delivery of the goods at the specified delivery address. 7.3. Reporting Damaged/Incorrect Goods You must inspect the goods immediately upon receipt. Any external visible damage to the packaging, or receipt of incorrect items, must be reported to Digitel Pro via email within 24 hours of the delivery time. 7.4. Delivery Costs and Insurance

  • Delivery Costs: Free shipping for orders over R1500.
  • Shipping Insurance: Unless explicitly selected and paid for at checkout, shipping insurance is not included. If your parcel is lost, stolen, or damaged during transit without insurance, Digitel Pro will not be liable for replacement or exchange, beyond the standard courier liability limits.

7.5. Collection You are welcome to arrange collection at our Durban offices.  

8. USE OF THE WEBSITE

8.1. Account Security You are responsible for maintaining the confidentiality of your account password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account. 8.2. Acceptable Use You agree not to use the Website to:

  • Upload any material that is defamatory, offensive, contains hate speech, or is otherwise unlawful.
  • Attempt to interfere with the proper functioning of the Website.
  • Copy, print, publish, or distribute the content of the Website without prior written consent from Digitel Pro.

 

9. LIMITATION OF LIABILITY & INDEMNITY

9.1. Limitation of Liability The Website and its contents are provided “as is” and “as available.” Digitel Pro makes no warranties, express or implied, including but not limited to warranties of fitness for a particular purpose or non-infringement.

  • Digitel Pro shall not be liable for any indirect, special, or consequential damages (including loss of profits, data, or business opportunities) arising from the use of the Website or the purchase of goods, unless arising from our gross negligence or willful misconduct.

9.2. Indemnity You agree to indemnify and hold harmless Digitel Pro against any liability suffered by us arising from or in connection with your use of the Website or any breach of these Terms or any applicable South African laws by you.  

10. GOVERNING LAW AND JURISDICTION

10.1. Governing Law These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. 10.2. Jurisdiction By using the Website, you consent to the non-exclusive jurisdiction of the High Court of the Republic of South Africa (or a relevant Magistrate’s Court) regarding all proceedings arising from these Terms. 10.3. Consumer Rights Nothing in these Terms limits your right to approach any court, tribunal, or forum of competent jurisdiction in terms of the Consumer Protection Act (CPA).
